Bankruptcy Terms Explained in Plain English

Exemption

Plain-English Definition

A legal protection that can let a debtor keep qualifying property in bankruptcy.

Why it matters

Exemptions depend on the applicable law, the property, and the facts. In Florida, an attorney reviews ownership, equity, residency, and other requirements before deciding which protections apply. Protected property must still be properly disclosed.

A simple example

A vehicle owner has an attorney review the car’s value, loan balance, and available protections rather than assuming that every car is either lost or fully protected.
